Terms of Use

The Game is published by Aenric Technologies LLC ("Aenric Technologies", "we", "us", or "our"), a limited liability company registered in New Mexico, United States. How we handle information is described in the Car Racing 3D Extreme Privacy Policy, which forms part of these terms.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment, in line with these terms and the rules of the store you got it from.

You may not copy, sell, rent, sublicense or distribute the Game; decompile, reverse engineer or modify it (except where the law allows this despite this restriction); or remove any notices from it.

• The Game creates an account for you automatically. You can sign in with Apple or Google to keep your progress on a new phone.
• We work to keep your progress safe but can't guarantee it will never be lost, for example if you delete the Game without signing in, or delete your data.
• You can delete your data at any time in the Game's Account screen. This can't be undone.
• You are responsible for activity on your account and for keeping your Apple or Google account secure.

• Coins, cars, upgrades and other in-game items ("Virtual Items") exist only inside the Game. They have no real-world value and can't be exchanged for money, sold, traded or transferred, inside or outside the Game.
• You receive a licence to use Virtual Items in the Game; you don't own them. We may change, rebalance or remove Virtual Items, prices and rewards as part of developing the Game.
• Virtual Items are not refundable, except where the law requires otherwise.

• The VIP Pass is an optional auto-renewing subscription. Its price, period and benefits are shown in the Game before you subscribe. Benefits may change over time, but we will not reduce them for a period you have already paid for.
• The price is shown in the Game before you buy and is charged to your Apple App Store or Google Play account when you confirm the purchase.
• It renews automatically at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
• Manage or cancel the subscription at any time in your store account: on iPhone, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. Deleting the Game doesn't cancel it. After cancelling you keep the benefits until the end of the period you paid for.
• Payments and refunds are handled by Apple or Google under their own policies; we can't issue refunds for store purchases ourselves. You can restore an active subscription on a new device from within the Game.

The Game may offer optional ads that you can choose to watch for an in-game reward. Rewards are given only for completed ads and may not always be available. Ads are provided by third parties, and we are not responsible for their content or for products they advertise.

To keep the Game fair and working, you agree not to:

• Use cheats, bots, modified versions of the Game, or tools that tamper with it or its saved progress
• Exploit bugs or glitches, or obtain Virtual Items, rewards or subscription benefits in a way the Game doesn't intend
• Interfere with the Game's services, or try to access other players' accounts or data
• Use the Game for any unlawful purpose

If you break these rules we may reset Virtual Items or progress gained this way, or suspend or close the account.

We may update the Game to add features, fix problems or rebalance it, and some updates may be required to keep playing. Online features need an internet connection and may sometimes be unavailable. We may stop offering the Game; if we do, we will give reasonable notice in the Game or on its store page where we can.

The Game and its content are owned by us or our licensors and protected by intellectual property laws. Names in the Game are fictional. Third-party names and logos belong to their owners.

The Game relies on services from other companies, listed in the Privacy Policy. Signing in with Apple or Google and buying through the App Store or Google Play are also subject to those companies' own terms.

The Game is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties that it will be uninterrupted, error-free or meet your expectations, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. This doesn't affect rights you have as a consumer that can't be excluded by agreement.

Please play safely: take breaks, and never play while driving a real vehicle.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost Virtual Items or progress, arising from the Game. Our total liability to you for any claim about the Game is limited to the amount you paid us for it in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.

You can stop using the Game at any time by deleting it (and cancelling any subscription in your store account). We may suspend or end your access if you seriously or repeatedly break these terms. Sections 4, 9, 11, 12 and 14 continue to apply after these terms end.

These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of mandatory laws of the country where you live, and you may bring claims in your local courts.

If you downloaded the Game from the Apple App Store:

• These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Game and its content.
• Your licence is limited to using the Game on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game. To the maximum extent the law allows, Apple has no other warranty obligation for the Game.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims the Game infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

We may update these terms when the Game changes or the law requires. We will change the date below and, for significant changes, tell you in the Game or on its store page before they take effect. If you keep playing after the changes take effect, you accept the updated terms.
