TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AENRIC TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use our Services
• Any unauthorized access to or use of our servers or your account
• Any interruption or cessation of transmission to or from our Services
• Any bugs, viruses, trojan horses, or the like that may be transmitted through our Services
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
• Any conduct or content of third parties on our Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Aenric Technologies, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of our Services, including any User Content you provide
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Your violation of any applicable laws or regulations
• Any fraudulent, abusive, or illegal activity conducted through your account

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in defending such claims.

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use our Services will immediately cease
• We may delete your account and all associated data
• You remain liable for all amounts due up to and including the date of termination
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by contacting us or using account deletion features in our Services. Upon termination, we will delete your account and data in accordance with our Privacy Policy, subject to legal and operational requirements.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aenric Technologies operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If any provision of this dispute resolution section is found to be unenforceable, the remaining provisions will remain in full effect.

We reserve the right to modify these Terms at any time, in our sole discretion. When we make material changes:

• We will post the updated Terms on this page with a new "Last updated" date
• We will notify you via email or through our Services for significant changes
• We may require you to acknowledge the updated Terms before continuing to use our Services

Your continued use of our Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Services and may terminate your account.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aenric Technologies regarding your use of our Services and supersede all prior agreements and understandings.

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms or any rights hereunder without restriction.
